Background:
HM Courts and Tribunals Service is responsible for the administration of criminal courts, civil courts, family courts and tribunals in England and Wales working with an independent judiciary to provide a fair, efficient and effective justice system. Currently, HM Courts and Tribunals Service is embarking on a period of significant change which will require strong leadership in this critical role, operating in a culture of openness and honesty.
Overview:
The role of an Executive officer in the Foreign Process section is to provide first line support to the Foreign Process team and the Delivery Manager by ensuring the best use of your time to enable the smooth running of the office along with administration duties. You will also be required to liaise with internal and external stakeholders including legal representatives, members of the public and members of the judiciary.
The Foreign Process Office offers a unique role within the justice system by dealing with the requests for Taking of Evidence, Service of Foreign Process both here in the UK and Abroad, along with the Registration of Foreign Judgements here in the UK.
Full training will be given in the role.
Key Responsibilities:
Administration
Processing letters of Request from solicitors for taking of Evidence Abroad liaising with the Foreign Court to enable the evidence to be taken.
Processing requests from Foreign Courts for evidence to be taken in Civil matters here in the UK.
Liaising with the Government Legal Department (GLD) to enable Evidence to be taken before an official examiner of the Court.
Daily duty of sifting and prioritising urgent documents for Service of Foreign process here in the UK on behalf of Foreign Courts /Transmitting agencies. Ensuring that requests are dealt with in a timely manner by allocating work to the Foreign Process administration team.
Dealing with County Court Bailiffs, chasing outstanding work and ensuring that documents for service are served efficiently. Compiling outstanding reports for the County Court bailiff Managers.
Liaising on a regular basis with the Request for service out of the Jurisdiction section of the team and ensuring that documents are dealt with in a timely manner and completed within time allowed.
Cover the Duty of Registration of foreign Judgments and Writ of Control which includes but not limited to dealing with certificates of enforcement in a Foreign Country, Application Notices for registration and sealing of Orders.
Complete weekly Key Control Checks and report findings to the Delivery Manager.
Post Opening Supervision on a Rota System.
Performance management of team including quarterly reviews and probation plans for new starters, recognising good work and rewarding through the recognition system.
Attendance management in accordance with departmental guidelines, involving any formal action when required.
Circulation of Departmental communications and leading on regular team meetings to share information.
Escalation of Conduct or behavioural concerns in accordance with the disciplinary policy.
Ensure that Governance, risk management registers and contingency plans are in place and updated.
Visible leadership to the team, role modelling engaging behaviours and challenging inappropriate behaviours.
Ensuring the standards of customer service to judiciary, colleagues, professionals and other court users are maintained and where possible improved upon.
Other Duties:
The post holder is required to work in a flexible way and undertake any other duties reasonably requested by line management which are commensurate with the grade and level of responsibility of this post.
Security Level:
This role requires vetting to Counter-Terrorism Check (CTC) level. For this you will need to confirm your employment and residence history for at least 3 years prior to the date of application so that pre-employment checks (BPSS) can be undertaken. If you have spent significant time abroad (a total of 6 months in the past 3 years) you would be required to give a reasonable account of the reasons why.
If you do not meet the above requirements, you may still be considered if, for example:
You've been serving overseas with HM Forces or in some other official capacity as a representative of HM Government
You were studying abroad
You were living overseas with parents
In such cases you will need to be able to provide referee cover for the period(s) of residence overseas. The duration of overseas residence and the country of abode will also be taken into account and a local police check carried out.

Standard full time working hours are 37 hours per week. HMCTS welcomes part-time, flexible and job-sharing working patterns, where they meet the demands of the role and are agreed prior to appointment. Working Arrangements & Further Information
The MoJ offers Hybrid Working arrangements where business need allows. This is an informal, non-contractual form of flexible working that blends working from your base location, different MoJ sites and / or from home (please be aware that this role can only be worked in the UK and not overseas). All employees will be expected to spend a minimum of 60% of their working time in an office, subject to local estate capacity.
Some roles will not be suitable for Hybrid Working. Similarly, Hybrid Working will not suit everyone’s circumstances. Arrangements will be discussed and agreed with the successful candidate(s) and subject to regular review.
For nationally advertised roles, the successful candidate(s) will be appointed to a
MoJ
office location, which may include their nearest Justice Collaboration Centre or Justice Satellite Office. This will be discussed and agreed on the completion of pre-employment checks.
Some of MoJ’s terms and conditions of service are changing as part of Civil Service reform. The changes will apply to staff joining MoJ who are new to the Civil Service. Staff joining MoJ from other civil service employers will transfer onto the new MoJ terms if they are already on 'modernised' terms in their current post or onto 'unmodernised' MoJ terms if they are on 'unmodernised' terms at their current post. MoJ candidates who are on a specialist grade, will be able to retain their grade on lateral transfer.
